Process for Incorporation and Tax Exemption
ONE-PS’s membership consists of neighborhoods with different histories, personalities and characteristics. Each neighborhood makes a choice whether to do fundraising activities. Some neighborhoods have been able to take advantage of their architectural heritage by organizing an annual tour through Palm Springs Modernism Week. Other neighborhoods have hosted tours of
their inns. Whether it is a garage sale, tour or holding a raffle, the neighborhood organization might have income. Fundraising creates potential tax liability and triggers charitable trust registration obligations.
The ONE-PS Governance Committee, whose membership includes two retired attorneys, has organized a helpful way to guide the neighborhoods that wish to become a California nonprofit public benefit corporation, to obtain federal and state tax exempt status as a Section 501(c)(4) organization and to register as a charitable trust with the California Attorney General’s Office. Many of the neighborhoods have already filed for this status. Of particular importance are the neighborhoods that receive income from participating in Modernism Week.
